Privacy Policy
The members of the SetPoint consortium (“SP”), Renaissance Learning, Inc., and JBHM Education Group, LLC, consider the privacy and security of visitors to our web site to be of paramount importance. We have developed this privacy policy to communicate our commitment to protect information. We will not sell, share, or rent this information to others in any manner other than that which is disclosed in this policy. Please note that SP does collect certain information from our users at several different points on our website. If you have any questions about this privacy policy, or other parts to our web site, we can be reached via e-mail at info@setpointschools.com, or you can call us toll-free at 866-505-2459. SP reserves the right to revise this privacy policy at any time. Changes to this privacy policy will be posted at this location.
Personal Information
As noted above, certain areas of our web site may collect personally identifiable information ("PII"). The information collected usually consists of an individual's name, address, telephone number, email address, and school or district information. This information is required only when an individual wishes to pursue a business relationship with SP such as receiving product information, or purchasing products from our online store. This information is collected, and stored in a secure, password-protected database that SP keeps separate from its corporate web site. SP will not disclose this PII to any unrelated third party except when a third party is helping us pursue the business relationship initiated by the individual when the individual provided the PII; or when required by law. PII does not include information that is collected anonymously (i.e., without identification of the individual user) or demographic information not connected to an identified individual (See "Non Personal Information" below).
If your PII changes, you may correct that information by sending an e-mail message to HYPERLINK "mailto:info@setpointschools.com" info@setpointschools.com and putting the word "UPDATE" in the subject line of the message.
In accordance with the Children's Online Privacy Protection Act, we make no effort to obtain PII from children 13 years of age or younger. If we become aware that a child 13 years or younger age has submitted PII, we will immediately delete that information and not disclose it to any third party, nor will we attempt to use it to further pursue a business relationship.
Communication
From time-to-time SP sends out promotional and informational communications relying on PII it has collected. You will have the option of indicating your desire to receive or not receive this type of communication at the time of your provision of such information to SP.
Non Personal Information
Current technology allows for tracking of other information originating from a user's computer, Internet Service Provider, or another originating network component. This information includes a user's IP address and domain information, as well as "cookie" information. With regard to IP address and domain information, SP uses a specialized computer system to record this data when a user visits our site. This information is only used to provide aggregate statistical information to help us keep the site functional and responsive, and to determine overall visitor usage patterns. This information is not utilized to try and identify specific individuals, however, we reserve the right to do so in cases of actual or suspected abuse of our software applications or web site.
Our web site does use "cookie" information to help provide an enhanced functional system experience to those visiting the site. A cookie is a piece of data stored on the user's hard drive containing information about the user. Only specific cookie data elements helpful for operation of our site are accessed and utilized. We may use cookie information to determine ways in which our web site can be improved, but no PII is included in such activities, and this information is not shared with any third party. If a user rejects the cookie, the user may still use the site.

Users visiting our web site may find links to web sites owned and operated by other organizations. Please note that when you click on one of these links, you are moving to another web site. Safe Harbor
The SetPoint consortium (SP) and its U.S. members adhere to the Safe Harbor Agreement concerning the transfer of personal data from the European Union to the United States of America. Accordingly, SP follows the Safe Harbor Principles published by the U.S. Department of Commerce with respect to all such data. This statement outlines our general policy and practices for implementing the Principles, including the types of information SP gathers, how it is used, and the choices affected individuals have regarding SP use of, and their ability to correct, that information. This statement applies to all personal information SP handles, including on-line, off-line, and manually processed data. For purposes of this statement, “personal information” means information that:
- is transferred from the European Union to the United States;
- is recorded in any form;
- is about, or pertains to, a specific individual; and
- can be linked to that individual.
It does not include information that pertains to a specific individual, but from which that individual could not reasonably be identified.
Principles Protecting Individuals’ Privacy Notice and Choice
SP notifies individuals about the personal information we collect from them, how we use it, and how to contact us with privacy concerns. We collect personal information from individuals only as permitted by the Principles or with the consent of the individual affected. Consent for personal information to be collected, used, and/or disclosed in certain ways may be required in order for an individual to obtain or use our services. To the extent permitted by the Safe Harbor Agreement, we reserve the right to process personal information in the course of providing professional services to our clients without the knowledge of individuals involved.
Disclosures and Transfers
RL does not disclose an individual’s personal information to third parties, except when one or more of the following conditions is true:
- SP has the individual’s permission to make the disclosure;
- The disclosure is required by law;
- The information in question is publicly available;
- The disclosure is reasonably necessary for the establishment of legal claims; or
- The disclosure is to another SP entity or to persons or entities providing services on our or the individual’s behalf (each a “transferee”), consistent with the purpose for which the information was obtained, if the transferee, with respect to the information in question:
- is subject to law providing an adequate level of privacy protection;
- has agreed in writing to provide an adequate level of privacy protection; or
- subscribes to the Principles.
Permitted transfers of information, either to third parties or within SP, include the transfer of data from one jurisdiction to another, including transfers to and from the United States of America. Because privacy laws vary from one jurisdiction to another, personal information may be transferred to a jurisdiction where the laws provide less or different protection than the jurisdiction in which the information originated.
Data Security, Integrity, and Access
SP employs various physical, electronic, and managerial measures, including education and training of our personnel, designed to provide personal information with reasonable protection from accidental loss or destruction, improper use, alteration, or disclosure. Personal information collected or displayed through a Website is protected in transit by standard encryption processes.
SP processes personal information only in ways compatible with the purpose for which it was collected or authorized by the individual. To the extent necessary for such purposes, we take reasonable steps to make sure that personal information is accurate, complete, current, and otherwise reliable with regard to its intended use. If an individual becomes aware that information we maintain about that individual is inaccurate, or if an individual would like to update or review his or her information, the individual may contact us using the contact information below. The individual will need to provide sufficient identifying information, such as name, address, birth date, and telephone number. We may request additional identifying information as a security precaution. In addition, we may limit or deny access to personal information where providing such access would be unreasonably burdensome or expensive in the circumstances, or as otherwise permitted by the Safe Harbor Agreement.
Accountability and Enforcement
SP has established a program to monitor our adherence to the Principles and to address questions and concerns regarding our adherence. This program will include a statement, at least once a year, signed by an officer of SP, verifying that this policy is accurate, comprehensive for the information intended to be covered, prominently displayed, completely implemented, and accessible. We encourage interested persons to raise any concerns with us using the contact information below. SP will endeavor to resolve all disputes relating to this policy that cannot be resolved through our internal processes, In the event that SP or authorities of competent jurisdiction determine that we did not comply with this policy, SP will take appropriate steps to address any adverse effects and to promote future compliance. SP personnel who violate our privacy policies may be subject to disciplinary process.
Amendment
SP may amend this policy from time to time by posting a revised policy on this Website. If we amend the policy, the new policy will apply to personal information previously collected only insofar as the rights of the individual affected are not reduced. So long as SP adheres to the Safe Harbor Agreement, SP will not amend our policy in a manner inconsistent with the Principles.
